Welcome to the Terms of Service ("Terms") of WebSaner.ai, Inc. (hereinafter referred to as the "Company", "we", or "our"). These Terms apply to our website (www.WebSaner.ai, collectively the "Site"), associated mobile applications (the "App"), and all content, tools, features, and services provided through the Site and App (collectively, the "Services").

Please note: These Terms do not apply to the use of the Company's API or to enterprise-grade WebSaner.ai services.

These Terms govern your access to and use of the Services. As these Terms contain important information regarding your legal rights, please read them carefully. You must accept and agree to these Terms before accessing or using the Services. If you do not understand or agree to these Terms, do not use the Services. In these Terms, "you" or "your" refers to the individual using the Services. If you are using the Services on behalf of a company or other entity, "you" also refers to that company or entity, and you represent and warrant that: (a) you are an authorized representative of the entity with the authority to bind it to these Terms; and (b) you agree to these Terms on its behalf.

Important Notice: Section 9 contains an arbitration clause and a class action waiver. By agreeing to these Terms, you (A) agree to resolve any disputes related to the Services or products via individual arbitration (except for limited exceptions), and waive your right to have disputes resolved by a judge or jury; and (B) waive your right to participate in class actions, class arbitrations, or representative actions. As explained in Section 9, you may opt out of the arbitration and class action waiver provisions.

1. Services

1.1 Inputs and Outputs

As part of the Services, you may input, upload, or submit data to WebSaner.ai ("Inputs"); WebSaner.ai uses AI tools to generate responses based on your Inputs ("Outputs"). Your use of WebSaner.ai, including Outputs, may be subject to applicable third-party large language model (LLM) licenses and usage restrictions. All Inputs are considered "Your Content" under these Terms. You must not use the Services to generate Outputs that violate intellectual property, contract restrictions, or other legal rights. By submitting Inputs, you represent that you have all necessary rights, licenses, consents, and permissions to permit us to lawfully use them. You also warrant that your Inputs and resulting Outputs do not violate any laws or third-party terms or policies. You must not: (i) publish Outputs without attribution; or (ii) falsely claim or conceal the AI-generated nature of Outputs.

1.2 Eligibility

You must be at least 13 years old to use the Services. If you are under the age of majority but at least 13, you may use the Services only if your parent or guardian agrees to these Terms on your behalf. Children under 13 are not permitted to use the Services. By using the Services, you represent and warrant that you meet these age requirements.

2. User Accounts, Subscriptions & Free Trials

2.1 Creating and Managing an Account

Some features require you to create an account or sign in through a third-party account (Apple, Twitter, Google, etc.) ("Account"). You must provide accurate, complete, and up-to-date information and manage it through your account settings. You are responsible for all activities under your Account and for keeping your password confidential. If you suspect unauthorized use, contact us immediately at support@WebSaner.ai. If your Account was previously terminated, you may not re-register without our written consent.

2.2 Paid Services

We offer some Services for free. If you subscribe to paid Services, you agree to pay all applicable fees and taxes in USD. Failure to pay will result in loss of access. Subscribing to auto-renewing services means you authorize recurring charges to your payment method and agree to applicable taxes based on your location. We reserve the right to change pricing or plans and will notify you within a reasonable timeframe.

2.3 Renewal and Cancellation

Subscriptions renew automatically at the end of each period (typically monthly) and applicable fees and taxes will be charged. To cancel and avoid future charges, you must do so before the renewal date via your membership settings or by emailing support@WebSaner.ai.

2.4 No Refunds

Except as explicitly stated, all subscription fees are non-refundable. Canceling a subscription allows continued access until the current paid period ends, but does not entitle you to a refund for any unused time.

3. Purchases of Goods and/or Services

3.1 Payment

We may offer goods or services ("Products") for purchase. You agree to provide accurate and current payment information and confirm you are authorized to use the payment method. We may, without notice, (a) modify or limit quantities available; or (b) reject orders or restrict shipping. Purchasing Products constitutes your agreement to pay all fees, including shipping and applicable taxes.

3.2 Promo Codes

We may offer promotional, referral, or discount codes ("Promo Codes") subject to specified conditions.

3.3 Price & Content Changes

We reserve the right to update product prices, availability, descriptions, and specifications at any time. In the case of pricing errors, we may cancel or correct affected orders.

3.4 Order Confirmation & Fulfillment

After receiving your order, we will send a confirmation. If a product is provided by a third party, we do not guarantee its accuracy or performance.

3.5 Third-Party Provider Disclaimer

If a Product is provided by a third party, we do not endorse or guarantee its suitability, quality, or performance.

5. Your Rights & Restrictions

5.1 License to Use

Subject to these Terms, we grant you a personal, non-commercial, limited license to access the Services. If specific content or software is provided, this includes a non-exclusive, non-transferable, non-sublicensable right to use it solely for your personal, non-commercial use.

5.2 Restrictions

• Unless explicitly allowed by law, you may not: Download, copy, reproduce, republish, distribute, or modify content without permission.
• Reverse engineer, decompile, or tamper with the Services.
• Alter or remove copyright, trademark, or proprietary notices.
• Use bots, crawlers, or scripts to access or manipulate the Services.
• Send spam or unsolicited content.
• Harm, overload, or compromise the Services' security.
• Submit illegal, defamatory, harassing, discriminatory, or offensive content.
• Violate any laws or third-party terms when using the Services.

5.3 Use of Mobile Apps

The App may require compatible devices, software, and internet connection. We do not guarantee compatibility with all devices or carriers.

5.4 Apple App Store Downloads

If you download the App from Apple's App Store, these Terms apply only between you and the Company, and Apple is not a party to these Terms. You agree to abide by Apple's applicable terms of service.

5.5 Beta or Test Features

We may offer experimental features from time to time. These may change or be discontinued without notice.

6. Ownership & Content

6.1 Service Ownership

All text, graphics, images, logos, and the overall look and feel of the Services are protected by intellectual property laws. You agree that WebSaner.ai and its licensors retain all rights, title, and interest, and you will not challenge these rights.

6.2 Trademarks

The WebSaner.ai name, logos, and related designs and slogans are trademarks of the Company or its licensors.

6.3 Feedback

We welcome suggestions and feedback. By submitting feedback, you acknowledge that it becomes the sole property of the Company, without any claim to compensation or ownership.

6.4 Your Content

You may submit or upload content, including Inputs, as part of your use. You retain ownership of your content. The Company may access, process, or modify it solely for technical operation of the Services, under a royalty-free, worldwide license. You represent you have all rights to the content and it does not infringe on others' rights.

6.5 DMCA Policy

If you believe content on the Services infringes your copyright, send a written notice under the DMCA (17 U.S.C. § 512(c)) to: support@WebSaner.ai. Include: Identification of the infringing material; Description and requested action; A statement of good-faith belief the use is unauthorized; A statement of accuracy under penalty of perjury and that you're the copyright owner or agent; Your signature (electronic is acceptable). We may terminate repeat infringers as required by law or policy.

7.1 Use of Third-Party Content

The Services may include content or links from third parties. We are not responsible for their accuracy, functionality, or legal compliance.

8. Disclaimers, Limitations of Liability, and Indemnity

8.1 Disclaimer

You use the Services at your own risk. Except as provided in these Terms, we make no guarantees about the suitability, accuracy, confidentiality, availability, or reliability of the Services. You acknowledge that Outputs may be inaccurate, offensive, or misleading. We disclaim liability for any consequences arising from use of such Outputs.

8.2 Limitation of Liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, punitive, or consequential damages (including lost profits or data), even if advised of the possibility.

8.3 Indemnity

You agree to indemnify and hold the Company harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Services, violation of the Terms, or infringement of third-party rights.

9. Arbitration and Class Action Waiver

9.2 Informal Resolution First

You and the Company agree to attempt informal resolution of any disputes before arbitration.

9.3 Binding Arbitration and Class Action Waiver

Certain claims related to intellectual property or injunctive relief may proceed in court.

All arbitration fees will be governed by JAMS rules.
